Cosmetic products placed on the European market have been covered by strict legislation since 1976 (the European Cosmetics Directive [76/768/(EEC)]). On 11 July 2013 the Directive was completely replaced by the new
EU Cosmetics Regulation [(EC) No. 1223/2009], hereafter referred to as the Regulation.
The fundamental requirement to only place safe cosmetic products on the market remains, as does the system of in-market control. Full responsibility for ensuring product safety lies with the Responsible Person, and Member State Competent Authorities have to take necessary control measures to ensure compliant products are on the market.
New requirements for central notification, revised safety assessment reports, revised labelling, new obligations on the distribution chain and reporting of Serious Undesirable Effects (SUEs) are among the key provisions of the new Regulation.
